These Terms of Service ("Terms") govern your use of Well Water Report at whatsinmywell.com and your purchase of the report we provide (a regional contaminant risk profile and prioritized test panel for a private well's area). By using this site or buying a report, you agree to these Terms.
1. What you are buying
Well Water Report sells a one-time informational report for $15. The report compiles the contaminants most reported in wells around the address you supply, drawn from USGS domestic-well data and compared against EPA drinking water limits, and presents a prioritized list of what to test for.
2. The report is a regional estimate, not a lab test or professional advice
The report is provided for general informational purposes only. It is a regional risk estimate, not a measurement of your specific water, and it is not, and must not be relied on as, professional, medical, engineering, environmental, real-estate, or safety advice. It does not measure what is actually in your well; only a test at a certified laboratory can do that. The report does not create any professional-client relationship and is not a substitute for a certified water test or advice from a qualified expert. You are solely responsible for any decision you make, and you should confirm any result with a certified laboratory test before acting on it.
3. No warranty
The report and this site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We draw on third-party and public data sources (including USGS and EPA data) that may contain errors, gaps, or out-of-date figures, and we do not warrant that the report is accurate, complete, current, or fit for any particular purpose.
4. Limitation of liability
To the maximum extent permitted by law, Well Water Report, its operators, and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site or the report. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the report or these Terms will not exceed the amount you paid for the report ($15).
5. Refunds
Because the report is a digital product delivered immediately, refunds are provided for delivery failure, for example if you paid but did not receive your report, or the report could not be generated for the address you supplied. If your report failed to arrive or cannot be produced, email [email protected] and we will re-deliver it or refund your purchase. If you believe a specific figure in your report is wrong, contact us and we will investigate and, where a delivery or generation fault is on our side, make it right.
6. Acceptable use
You agree not to: resell, republish, or redistribute the report as your own product; scrape, bulk-download, or systematically extract content from the site; attempt to disrupt, overload, or gain unauthorized access to the site or its infrastructure; or use the site or report for any unlawful purpose. The report is licensed to you for your own personal or internal use.
7. Intellectual property
The site, its design, its text, and the report format are owned by Well Water Report and protected by intellectual-property laws. Underlying public data referenced in the report (such as USGS domestic-well data and EPA drinking water standards) belongs to its respective sources. We grant you a limited, non-exclusive, non-transferable license to use the report you purchase for your own purposes.
8. Third-party services
Payments are processed by Stripe under Stripe's terms. Analytics are provided by Fathom Analytics. We are not responsible for the practices of third-party services, though we choose them with your privacy in mind (see our Privacy Policy).
9. Governing law
These Terms are governed by the laws of the United States and, to the extent applicable, the state in which the operator of Well Water Report is established, without regard to conflict-of-laws rules. You agree that any dispute will be brought in the courts located there.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the site after changes take effect constitutes acceptance of the revised Terms.
